This guide outlines the process for foreign nationals to obtain a Certificate of No Criminal Record during their residence in Shanghai, China. This certificate, known as a police clearance in other countries, follows the regulations set forth in the "Regulations on Handling Criminal Record Inquiries by Public Security Organs," implemented on December 31, 2021.

Foreign nationals in China may require a Certificate of No Criminal Record for purposes such as immigration and employment. Generally, an uncertified Certificate of No Criminal Record is not acceptable for these purposes. In some countries, it may also require an apostille from the Chinese Ministry of Foreign Affairs or consular authentication from the embassy of the destination country. This guide covers two main steps: "Step 1: Applying for the No Criminal Record Certificate" and "Step 2: Notarizing the No Criminal Record Certificate."

Step 1: Applying for the No Criminal Record Certificate

Where to Apply?
Foreign nationals can apply for the No Criminal Record Certificate at the Shanghai Public Security Bureau's Exit-Entry Administration Bureau or the district-level Exit-Entry Administration Department where they reside.

Eligibility

  • Hold a residence permit issued by Shanghai.
  • Have resided in Shanghai for 180 days or more.

  • If applying through a third party, provide a Power of Attorney. (If the applicant is overseas, the Power of Attorney must be apostilled by the foreign affairs department in their country or authenticated by the Chinese embassy/consulate.)

Where to Apply?
After obtaining the No Criminal Record Certificate from the Exit-Entry Administration, submit it to a local notary office for notarization. As mentioned earlier, only the notarized Certificate of No Criminal Record can be used overseas for purposes such as immigration, employment, and education.
